TUFF-TREK® TERMS & CONDITIONS
1. General
These Terms and Conditions apply to all purchases made from TUFF-TREK® Ltd via our website, by telephone, email, in person, or following discussions at exhibitions or events.
By placing an order with TUFF-TREK® you confirm that you have read and accepted these Terms and Conditions.
Nothing in these terms affects your statutory rights under UK consumer law.
2. Formation of Contract
Orders placed through our website or by other means constitute an offer to purchase goods.
A contract between the customer and TUFF-TREK® is formed only when TUFF-TREK® confirms acceptance of the order and dispatches the goods.
TUFF-TREK® reserves the right to decline or cancel an order prior to dispatch.
3. Product Descriptions
We take care to ensure that product descriptions, specifications and prices are accurate.
However:

product weights, sizes and dimensions are approximate
-
colours may vary slightly from images displayed online
-
images may occasionally be illustrative rather than the exact item supplied.
Specifications may change without notice as part of product improvements.
4. Prices
All prices shown are in GBP and include VAT where applicable.
Delivery charges may apply and will be displayed during checkout.
If a pricing error occurs TUFF-TREK® will notify the customer and offer the option to proceed at the correct price or cancel the order.
5. Vehicle Compatibility & Mounting Systems
Roof tents and vehicle-mounted equipment must be installed on roof bars or rack systems that are suitable for roof-tent use and capable of supporting both dynamic driving loads and static loads during use.
Unless roof rails, roof bars or rack systems are supplied and/or installed by TUFF-TREK®, the customer is responsible for ensuring that:

their vehicle roof load rating is suitable for the product
-
their roof bars or rack system are rated for roof-tent use
-
the mounting system is structurally suitable
-
installation is carried out safely and correctly.
TUFF-TREK® cannot accept responsibility for compatibility issues arising from:
-
third-party roof rails or roof bars
-
vehicle roof load limitations
-
unsuitable mounting systems
-
incorrect installation.
Customers should confirm vehicle compatibility with their vehicle manufacturer where necessary.
6. Installation Responsibility
The safe installation and use of roof tents and other vehicle-mounted equipment is the responsibility of the customer.
Unless installation services are provided directly by TUFF-TREK®, we cannot verify the structural suitability of every vehicle or third-party mounting system.
Customers must ensure that:

the vehicle manufacturer’s roof load limits are not exceeded
-
the roof bars or rack system are correctly rated for roof-tent use
-
the product is installed according to manufacturer instructions.
TUFF-TREK® cannot accept responsibility for damage, incompatibility or safety issues arising from:
-
incorrect installation
-
unsuitable roof rails or roof bars
-
vehicle structural limitations
-
exceeding manufacturer load limits.
If customers are unsure about compatibility or installation requirements they should seek professional advice before installing the product.
7. Product Advice & Compatibility
TUFF-TREK® may provide general guidance regarding product compatibility based on information provided by the customer.
Such guidance is provided in good faith for general assistance only.
Unless TUFF-TREK® has supplied and installed the full mounting system, TUFF-TREK® cannot guarantee compatibility with any particular vehicle, roof rail, roof bar or rack configuration.
Customers remain responsible for confirming that their vehicle and mounting system are suitable for roof-tent use.
8. Delivery
Delivery times provided are estimates only.
TUFF-TREK® cannot be held responsible for delivery delays caused by courier services or circumstances beyond our control.
Customers must ensure that someone is available to accept delivery where required.
9. Returns & Cancellation (Cooling-Off Period)
Under the Consumer Contracts Regulations 2013 customers have the right to cancel their order within 14 days of receiving the goods.
To exercise this right the customer must notify TUFF-TREK® within 14 days of delivery.
Customers returning goods under this cancellation right are responsible for arranging and paying for return shipping unless otherwise agreed.
Returned goods must be:
-
complete
-
undamaged
-
safely packaged to prevent damage during transit.
Due to the size and value of roof tents we strongly recommend using an insured courier service.
10. Handling and Diminished Value
Customers may handle goods only to the extent necessary to establish their nature, characteristics and functioning.
If goods are handled beyond what would reasonably be possible in a retail environment TUFF-TREK® reserves the right to reduce the refund to reflect any reduction in value.
Examples include:
-
installing or mounting a roof tent on a vehicle
-
deploying ladders or structural components
-
outdoor use or travel
-
damage to packaging preventing resale as new.
Any deduction will be determined following inspection of the returned goods.
11. Refunds
Refunds will be issued within 14 days of receiving the returned goods and confirming their condition.
Refunds will be made using the original payment method where possible.
12. Faulty or Damaged Goods
If goods arrive damaged or faulty please contact TUFF-TREK® as soon as possible.
Where a fault is confirmed we will arrange repair, replacement or refund in accordance with the Consumer Rights Act 2015.
Customers should report transit damage immediately and provide photographs where possible.
13. Special Order Products
Products manufactured, customised or specially imported to order may not be eligible for cancellation or return unless faulty.
14. Limitation of Liability
Nothing in these terms limits or excludes any liability that cannot legally be excluded under UK law, including liability for death or personal injury caused by negligence.
TUFF-TREK® shall not be liable for indirect or consequential losses arising from the installation or use of products supplied.
TUFF-TREK® cannot accept responsibility for damage to vehicles, accessories or other equipment not supplied by TUFF-TREK®.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
